Welcome to the QTube Creator License Program (this “Agreement”). This Agreement is between you (the “Creator”) and the operator of QTube and its affiliates (together, the “Company”). By voluntarily creating, sharing, uploading, or publishing works, Skills, and canvas projects on QTube, you authorize the Company, itself or through designated third parties (including affiliates and partners), to display those materials worldwide and to license others to use them.
The mainland-China edition is operated by 上海豪泓信息技术有限公司. Operator, filing, and contact information for each edition is as publicly displayed in the product.
IMPORTANT NOTICE
(1) Checking “I agree” or clicking a button of similar effect means you have read, understood, and agreed to this Agreement, and that you have entered into a legally binding electronic contract with the Company.
(2) This Agreement includes these terms and any rules already published or later issued. You must also comply with the Terms of Service, the Privacy Policy, and other agreements and rules issued and updated by the Company. Those rules form an inseparable part of this Agreement and have the same legal effect.
(3) The Company may revise or supplement this Agreement from time to time. Updated versions will be indicated in a prominent place on the relevant page. You should review updates promptly. If you accept the revised Agreement, you may continue using the relevant services; if you do not, you should stop using them.
(4) By entering into this Agreement, you accept the Company’s rules on outward licensing of works, Skills, and canvas projects you create, share, upload, or publish on QTube. When a third party accepts a related license, that license takes effect between you and the licensee.
1. Creative commitments
You confirm and warrant that works, Skills, and canvas projects you create, share, upload, or publish:
have original creative input and contribution, including core ideas, methods, workflow design, prompt design, instructions, and overall expression completed independently by the creator;
do not copy, scrape, misappropriate, impersonate, or reproduce, adapt, or distribute another person’s work without permission;
are not another person’s Skill, workflow, or method republished as your original work merely by changing names, keywords, sample assets, parameters, or packaging;
do not evade identification or rights review of third-party content through translation, splitting, splicing, partial edits, or technical concealment;
if jointly created, have the full consent and authorization of the other creators, and you are entitled to publish and accept this statement on their behalf; and
if created in the course of employment, commission, collaboration, or another special ownership arrangement, have those rights properly cleared, and you are entitled to publish and license them on QTube.
2. License grant
You understand and agree that joining this program when you create, share, upload, or publish works, Skills, and canvas projects grants the Company an exclusive worldwide agency to display, promote, and commercially license those materials, including use or sublicense to create derivative works in print, websites, other electronic forms, mobile devices, television, film, exhibitions, and other media and products, and to create new original works. You understand and agree that users of the works may credit you or omit credit.
3. Use restrictions
The Company may decide the contract terms under which customers use your works, Skills, and canvas projects, but may not use or authorize customers to use them for defamation, pornography, or any other unlawful purpose. If a customer is reasonably suspected of unlawful use, the Company will take commercially reasonable steps to stop it.
4. Pre-existing rights
You understand and agree that once the relevant rights and licenses are granted, end customers may also use information, likenesses, and other pre-existing rights contained in the uploaded works, Skills, and canvases. You must ensure those materials are authorized and do not infringe third-party rights.
5. Licensing method
You understand and agree that the Company may decide, under platform transaction rules, whether a licensee may sublicense and the number or tiers of sublicenses. The scope and method of each license follow the options you choose when uploading the work, Skill, or canvas project.
6. Exclusive agency
You understand and agree that uploading works, Skills, and canvas projects and joining this program grants the Company an exclusive worldwide agency over those materials. You undertake not to authorize a third party to commercially represent the same or similar materials.
7. Liability
7.1 The Company may suspend, stop, or ban your account for serious violations.
7.2 You understand and agree that laws on AI-created works are still developing. Rights characterization, ownership, and legal nature of AI works may change. You confirm that you understand and voluntarily accept this risk before joining the program.
7.3 If a user of your works, Skills, or canvas projects infringes third-party rights through their own misconduct, you are not liable for indirect, incidental, special, punitive, or consequential damages arising from that user’s misconduct.
